The film, which was mired in limbo for 46 years as a result of various legal battles, is now the subject of a suit from producers including Alan Elliott, against distributor Neon and CEO Tom Quinn.
The crux of the issue also involves the Hollywood trade press, including Deadline, which covered the news that Neon had acquired the U.S rights to the film in December 2018. There was one small problem, the producers allege, it hadn’t signed a deal, and in fact, the producers were in talks with other buyers, including Apple, when Neon announced the deal.

The origin of this project goes as far back in our women's collective memory to the time in the late 80s when Janet Grillo was head of Acquisitions for New Line Cinema and Sara Risher was head of production. I was buying features for Lorimar or Republic Pictures. We did not know at that time that one day, after Janet had completed her directorial debut, the lovely and loving film "Fly Away," that Sara would tell a certain writer-producer. to show her script to Janet as a possible director.
Janet liked it and together they developed it further at L.A. Film Independent. They then won the PGA Script Award. They hired an 18-year-old who had been a child actress and was a Nyu Freshman just finishing a TV Career. She agreed to star in January and the film was shot the following May 2014.
It premiered in Geena Davis’ Inaugural 2015 Bentonville Film Festival in May 2015 where it won the Jury Geena Davis’ new effort to celebrate the work of women and diverse voices in media also is the only festival to guarantee distribution for its winners’ project.
“The goal of the festival is not just to showcase women and diversity—it’s to really have a proactive and powerful effect on the industry,” says Davis, Bff co-founder and founder and chair of the nonprofit Geena Davis Institute on Gender in Media. “We’re intent on being extremely proactive in showing the films that include women and that are very commercial. Our goal is to show that this is the direction in which things are heading and we should get there sooner.”

Anna Sophia Robb portrays “Jack,” a tough teenage runaway on the lam from her parole officer. The conniving street kid brazenly impersonates a trained caregiver and forms a unique bond with an 11 year-old autistic girl named Glory, brilliantly played by newcomer Taylor Richardson. Famke Janssen, as the child's desperate mother Kay, also bonds with the imposter, as a surrogate daughter she can actually talk to. And the girl’s cute older brother Robert (Israel Broussard) falls in love. When the deception is exposed and the cops descend, loving father Mark (Scott Cohen) struggles to hold his family together as the pieces of this puzzle are reshuffled into a new, satisfying whole.

It’s been a couple months since the last edition of What’s Up Doc? placed Michael Moore’s surprise world premiere of Where To Invade Next at the top of this list and in the meantime much shuffling has taken place and much time has been spent on various new endeavors (namely my Buffalo-based film series, Cultivate Cinema Circle). Finally taking its rightful place at the top, D.A. Pennebaker and Chris Hagedus’ Unlocking the Cage is in the midst of being scored by composer James Lavino, according to Lavino’s own personal site. Monster films seem to be having a nice little comeback. We seem to be venturing away from the “Grindhouse” homage films, the torture porn films and the other tropes the genre got stuck in. A film that is on my radar is Dark Was The Night, which was adapted from a screenplay that was on The Blacklist a few years back. We just got word that we shouldn’t have to wait too long to see this flick starring Kevin Durand (The Strain) and Lukas Haas (Lady in White, Inception, Brick). Read below for the official word. Image Entertainment has acquired North American rights to Caliber Media’s creature feature and will release theatrically this year.
Jack Heller directed the story starring Kevin Durand and Lukas Haas as police officers who battle an ancient evil. Tyler Hisel wrote the Black List screenplay that was known as The Trees.
Dark Was The Night premiered at ScreamFest in Los Angeles.
Heller produced with his Caliber partner Dallas Sonnier, Sundial’s Stefan Nowicki and Joey Carey, and P Street’s Dylan Narang.
Preferred Content’s Kevin Iwashina and Ross Dinerstein served as executive producers with Hisel and Alexander Robb.

Robin Williams’ final feature film, Dito Montiel’s domestic drama Boulevard, has been picked up for international distribution by Inception Film Partners and will be sold during the American Film Market next month in Santa Monica. Kathy Baker, Bob Odenkirk and Roberto Aguire co-star in the pic, which stars Williams as a lonely married man who begins to confront the emptiness that permeates his life. Williams officially joined the project in January 2013. Douglas Soesbe penned the script. Camellia Entertainment produced. “Robin Williams’ performance as a man in a heartbreaking struggle to find his place in the world is both heroic and poignant and Boulevard is an extraordinary coda to an indelible performer’s life,” said Inception partner Andy Reimer. He and Jim Harvey negotiated the deal on behalf of Inception, with Preferred Content and Wme on behalf of the filmmakers. Preferred Content and Wme are handling North American rights.

Things are definitely going bump in the night in Jack Heller’s new creature feature. A highly anticipated entry in this year’s Screamfest, the foremost horror film festival in the country, “Dark Was the Night” will feature Kevin Durand (“Lost”), Bianca Kajlich (“Rules of Engagement”), Lukas Haas (“Inception”), Nick Damici (“Stake Land”), and a decidedly creepy something lurking in the woods.
