A U.S. Appeals court has upheld a decision that sided with Sacha Baron Cohen in a lawsuit filed by former U.S. Senate candidate Roy Moore against the “Borat” star, with Baron Cohen again beating a 95 million defamation lawsuit Moore brought in 2018 after Moore was lampooned in the Showtime series “Who Is America?”
Baron Cohen won the lawsuit back in 2021 after Moore accused Baron Cohen of intentional emotional distress and fraud, claiming he was defamed by the interview. But the United States Court of Appeals for the Second Circuit on Thursday, in documents obtained by TheWrap, upheld the initial decision by a judge in the Southern District of New York.
The appeals court agreed that it saw “no ambiguity” in Moore’s release of all claims, but also that the “Who Is America?” segment was “clearly comedy and that no reasonable viewer would conclude otherwise.”

In a unanimous vote made public Thursday morning, a trio of judges on the 2nd U.S. Circuit Court of Appeals upheld the July 2021 ruling by U.S. District Court Judge John P. Cronan.

In response to a CNN report that “Trump’s allies” were promised editorial control over Alex Holder’s Jan. 6 documentary “Insurrection,” the British filmmaker released two statements — via his legal counsel Russell Smith — saying that “the Trumps did not request, and were not granted, any editorial control over the series.”
“To the contrary, Alex Holder said at the outset that he would have full editorial control,” the statement reads. “The Trumps also did not request any contractual right of control, or even review, so there is none.”

The daughter of Judith Dim Evans withdrew the lawsuit after a Fulton County, Ga., judge refused to issue an injunction, said Russell Smith, who represented Amazon in the case.

STXfilms has won the domestic rights to director Kevin McDonald’s upcoming untitled legal thriller formerly known as “Prisoner 760,” Adam Fogelson, chairman of the Motion Picture Group, announced on Monday.
The film stars Jodie Foster, Tahar Rahim, Shailene Woodley and Benedict Cumberbatch.
As previously announced, STXinternational will also distribute the film internationally in the UK and Ireland after acquiring the international rights to the film last fall at the American Film Market (AFM).

“Amanda Knox” producer Stephen Robert Morse is launching development of projects based on the book “Sons of Wichita: How the Koch Brothers Became America’s Most Powerful and Private Dynasty.”
Morse has teamed with veteran producer Max Peltz to option the rights to create both fiction and non-fiction projects based on Daniel Schulman’s 2014 book about David and Charles Koch, the owners of Koch Industries. Morse is producing through Observatory LLC and Peltz through Cavendish Pictures Ltd.

Exclusive: The American Film Institute (AFI) has named veteran indie producer Lianne Halfon to be Producing Discipline Head of the AFI Conservatory. Producing is one of six disciplines in which the AFI Conservatory offers a two-year Master of Fine Arts degree, along with Cinematography, Directing, Editing, Production Design and Screenwriting. That job had been held for 14 years by Neil Canton, who retired from the post in June.

Gonzalo Sálazar-Simpson’s Madrid-based production house Lazona Films and Martín Cuenca’s own label La Loma Blanca produce the project from Spain. As part of Tiff, New York-based Film Consultant Colin Brown, Managing Partner and Director of International Operations at MADSolutions, has been one of the guest speakers at the 10th anniversary edition of the International Financing Forum (Iff), the annual co-financing event that took place on September 13th.
Moderated by Matt Mueller, editor of Screen International, Colin discussed the art and science of film financing and project packaging in a staged discussion with Lianne Halfon, the celebrated producer who teamed up with actor-director John Malkovich and producer Russell Smith to create Mr. Mudd, the production company behind such films as "Ghost World," "Juno," "The Perks Of Being A Wallflower," "Labor Day" and "Young Adult." The event also has been attended by Film Analyst Alaa Karkouti, CEO of Mad Solutions.
"If cinema is in the business of manufacturing delight, then to what degree can that process be quantified? That is one of the key questions that we be examining at a time when data analytics is finally coming to film financing and project packaging in an attempt to assist - and accelerate - the process by which producers bring their ideas in front of receptive investors and industry gatekeepers," explained Colin. "We want to explore the degree to which technology really can solve some of the Catch 22 situations that producers find with regard to securing cast and financing."
Iff is a two-day event that includes one-on-one meetings, an industry panel discussion, roundtable meetings and producers' networking receptions. Selected international and Canadian producers are brought together with international sales agents, distributors, funders, agents and executive producers to do business in brokered meetings and benefit from exclusive networking opportunities. Now in theaters the film Cesar Chavez, starring Michael Peña, and directed by Diego Luna , has sparked an alliance between The Equitable Food Initiative (Efi) and Participant Media on a campaign called “Follow Your Food,” aimed at keeping food safe, and families healthy starting in the fields where the food is grown.
With the mission of implementing safe food practices, providing education and training to farmworkers, and a fair wage, the initiative is crucial for the Efi, a group representing food retailers, growers, NGOs and farm worker organizations. Participant Media is supporting Efi’s efforts through the “Follow Your Food” action campaign aimed at building awareness and support for equitably-sourced food.
“Just as Cesar Chavez raised awareness of the conditions of farmworkers by organizing a boycott that millions of Americans supported, we believe that consumers today can advance Chavez’ groundbreaking achievements by supporting the concept of equitable food. I originally included this in last year’s predictions’ list, but the team took their time in the post-production phase which might, in the end, make for some better packaging as with this pre-buzz NYTimes piece. During that time, Lionsgate nabbed the title, loaded this on their Pantelion Films label for a possible April rollout and gave the film a bulkier title (Cesar Chavez: An American Hero). While this no longer becomes a high value acquisition title, Luna’s association with the fest is strong (he presented his debut film Abel at the fest in 2010) and Participant Media’s has a strong rapport with Park City previously supplying the fest with socially conscious docs.

During Sunday's Midwest regional final game against Duke, Louisville Cardinals guard Kevin Ware suffered gruesome broken leg.
After attempting to block a 3-point shot by Duke's Tyler Thornton, Ware fell, and broke his leg. Early reports suggest a compound fracture of both his tibia and fibula. His bone was protruding from his skin on the court, horrifying fans and teammates, as well as the opposing team.
Ware's teammates Chane Behanan and Russ Smith were visibly emotional, sobbing on the court, and Coach Rick Pitino could also be seen crying. Before being removed from the court, Ware spoke with his teammates and Pitino. He was then transported to the nearby Methodist Hospital. According to a University of Louisville spokesman, Ware's pain is under control and he will likely have surgery tonight.

With a docu J.C. Chavez (2007), a short Revolución (2010) and his feature film under his belt – Abel (Sundance ’10), full fledged actor-filmmaker-producer Diego Luna’s sophomore, $10 million production began filming in April and is will most likely be in distributor Participant Media’s wishes to release the film at a socially conscious festival. Park City happens to be the lieu where Luna premiered Abel and countless other items as an actor, so we’re thinking an early fest 2013 premiere is in the cards for Chavez. The mostly English project features Rosario Dawson, Gabriel Mann, America Ferrera and Michael Peña in the lead role (see pic above).

I remember back in school how annoyed I would get with my English teachers as we dissected every word in the books we were assigned to read. It seemed not a sentence would go by that didn't hold some larger meaning. I'd be thinking, "Not every word has to have some deeper meaning. Can't an author simply be telling a story?" When it comes to films, I think a larger case can be made for looking deeper into things given they are working under tighter constraints than most books, but at the same time I can't tell you how many interviews I've read where directors have been asked the "What did you mean by X? And was there anything to Y?" and the answer comes back, "Nothing really, just thought it worked for the story."
