A judge has ruled that a rewrite of a lawsuit against 21st Century Fox over the sitcom New Girl should survive a motion to dismiss. The complaint comes from Stephanie Counts and Shari Gold, who allege New Girl derives from their proposals for a television show or movie that would have been titled Square One. The two plaintiffs are suing Fox, William Morris Endeavor, showrunner Liz Meriwether and executive producer Peter Chernin for allegedly lifting their materials after they shopped their script through Wme and proposed Zooey Deschanel for the lead. In October, U.S. District Judge Stephen Wilson couldn’t

"Scandal" appears to have moved past its dependence on cliffhangers “Scandal” was written around cliffhangers in its first three seasons, but the cliffhangers have now passed on to “How To Get Away with Murder.” As Joshua Alston says of “Scandal,” "It’s no longer a political thriller with heavy-to-a-fault spy genre flourishes, it’s 'Grey’s Anatomy' in the White House. And if that’s indeed what the writers are going for, the absence of a central, hashtag-friendly mystery makes perfect sense. I’ve been suspiciously anticipating this direction, but I’m far less worried than I was. If 'Like Father, Like Daughter' is any indication, that version of Scandal would be well-worth watching, if perhaps not the Twitter fuel it once was.” Plus: “Scandal” Secret Service agent talks about his big role. Leah Remini will sub for Erin Andrews as “Dancing with the Stars' co-host Andrews is...

The casting you expected to not pan out has, indeed, not panned out. Joaquin Phoenix is not, according to the reporting of Deadline, going to be donning a billowy red cloak and a Van Dyke to become Marvel Studios’ Doctor Strange. Phoenix had been in talks for the role since July, upgrading to “final talks” status in August, and losing him this late in the game means Marvel is most likely going to have to repeat the whole process again with someone else (that’s what Deadline indicates, anyway, in titling their expose “Back to Square One”). As a gut reaction, this is saddening news. Phoenix is a truly phenomenal performer; there must have been something in Doctor Strange that piqued a creative spark inside him (why else wade through three months of contract negotiations?), and I would have loved to see Phoenix take that spark and let it amplify out into a stunning performance. As...

In Hollywood theft lawsuits, standard protocol is that a writer alleges some conspiracy whereby his or her work has been stolen, the studio hits back with a lesson about the nonprotectability of generic ideas, and the parties continue fighting until the judge weighs in ... usually in favor of the defendants. To quickly review, Stephanie Counts and Shari Gold allege they once worked with William Morris Endeavor agents to shop a proposed television series titled Square One, that they also proposed Zooey Deschanel for the lead and that their script eventually

In January, Stephanie Counts and Shari Gold made headlines with a lawsuit that alleged that Fox's New Girl was ripped off from their television pilot script. While allegations of theft are common in Hollywood, what made their lawsuit potentially serious was the amount of detail offered in an 87-page complaint about how the screenwriters had worked with William Morris Endeavor agents in shopping a proposed television series titled Square One, how they once proposed Zooey Deschanel for the lead and how Fox allegedly made a $10,000 settlement offer. When I was a kid, I learned from TV all the time. I learned Spanish phrases from Sesame Street; about the Fibonacci sequence from Square One; and that I did not have to take anyone's word for it from Reading Rainbow. As an adult, I certainly learned about food science from Good Eats and America's Test Kitchen, and maybe some enthusiasm for art from The Joy of Painting. But my main TV education is coming from reality shows that are in no way designed to teach their viewers things. I can't help it, though. I really did learn how to pose more flatteringly in photos from watching Top Model.I'm a big fan of reality-contest shows, and I have picked up some skills in my travels. Top Chef affected the way I cook — definitely with more acid, per Gail's constant request, and also with more salt, per Padma's recurring critiques...

In Hollywood’s latest “you stole my idea” case, a pair of screenwriters have filed a lawsuit claiming the Zooey Deschanel sitcom was based on their work. Stephanie Counts and Shari Gold claim that Fox’s New Girl and their 2006 pilot Square One contain similarities “so numerous and specific that independent creation was obviously impossible.” They name as defendants New Girl exec producer Peter Chernin, creator Elizabeth Meriwether, director Jake Kasdan, Wme and Fox parent company 21st Century Fox. Weighing in at 90-plus pages, the suit filed Thursday in California’s Central District (read it here) claims a laundry list of “similarities between the shows’ themes, structure, setting, overall story and plot arcs, specific plot devices, interpersonal twists, dialogue, sequence of events, tenor, specific scenes and elements of scenes, character identities, character personalities, character relationships, character interaction, character development, character idiosyncrasies, and character names require the conclusion that defendant Meriwether...
