Shia Labeouf's lawyer is asking a California judge to throw out an assault and defamation lawsuit filed by a bartender who says the actor called him a "fucking racist" after he refused to serve him more alcohol.
Labeouf's attorney, Brian G. Wolf, argues David Bernstein can't sue his client because the allegations arise out of his exercise of protected free speech.
The complaint is "not only completely frivolous in nature, but also provides a compelling example of the type of claims which California's anti-slapp statute was enacted to prevent," writes Wolf in Wednesday's filing. Bernstein, he argues, seeks...

[[tmz:video id="0_37lgp4id"]] Shia Labeouf loudly claimed an L.A. bartender "f**ked up" by threatening him over french fries -- but now the bartender's striking back ... with a lawsuit. You'll recall, Shia exploded in a rage last month, screaming at staffers in Pinz Bowling Alley and Jerry's Famous Deli. It was never very clear why he flipped out, but it was crystal clear that he singled out David Bernstein ... the bartender at Jerry's. In a lawsuit, Bernstein...

Donald Trump is at it again. On Friday, the Republican Presidential Candidate said that the bodyguards assigned to the Democratic Presidential Candidate, Hillary Clinton, should "disarm immediately" and "see what happens." "She goes around with armed bodyguards like you have never seen before," he said at a Miami, Florida campaign rally. "I think that her bodyguards should drop all weapons. They should disarm. Right? Right? I think they should disarm immediately. What do you think? Yes? Yes. Yeah. Take their guns away. She doesn't want guns. Let's see what happens to her. Take their guns away, okay? It would be very dangerous.

Now called Accidental Love, comedy Nailed began as a David O Russell movie more than seven years ago. Here's a look at its strange story...
Despite its stellar cast, which includes Jessica Biel, Jake Gyllenhaal and James Brolin, it's possible that you've never heard of the forthcoming comedy Accidental Love. It's almost certain that you haven't heard of its director Stephen Greene, because he doesn't exist.
The Accidental Love saga takes in Oscar-nominated director David O Russell, dodgy financiers, multiple production shut-downs, cast walk-outs and questionable name changes. Until recently, it looked as though the film would never see the light of day at all.
Accidental Love began life as Nailed, a screwball political comedy co-written by Russell and Kristin Gore (daughter of Us politician Al Gore). For Russell, whose previous film I Heart Huckabees had struggled at the box office, Nailed was supposed to be a "fresh page and...

Football Association chairman David Bernstein has defended the decision to give this year's Fa Cup final a 5.15pm kick-off time.
The decision, announced earlier this week, has angered fans of finalists Manchester City and Wigan Athletic, who face long journeys back up north following the game, The Guardian reports.
This month's semi-final clashes were both held at 5.15pm but violence from Millwall fans was blamed on all-day drinking prior to their tie with Wigan.
Bernstein insisted that the decision is for the benefit of TV viewers. Last year's final between Chelsea and Liverpool was also scheduled at 5.15pm and the broadcast attracted higher ratings.
He explained: "There will be a number of millions more watching at 5.15pm than 3pm and that is an important factor. This is not money-driven.
"Always remember that any additional money raised by the Fa goes to the wider football world - we are not a profit-making organisation.

The premiere, which will be satellite-broadcast to 100 cinemas, will be attended by the resurgent band that hails from the northern-England city. It is a film about defying the odds, sticking it to the man and telling the cynics to shut their pie-holes!” The band regrouped in 2012 to tour after 16 years. Mark Herbert produced the documentary for Warp Films. BFI Chair, Former BBC Chief Greg Dyke To Head English Soccer Greg Dyke, the former director general of the BBC, has been named chairman of England’s Football Association. Mitt Romney was called out after the first presidential debate for his planned assault on Big Bird. On Tuesday night, it was "binders full of women," sparking an eruption of social media parodies. The Massachusetts governor defended his record as a crusader for pay equity for women in the workplace, saying during Tuesday's presidential debate that he sought out female candidates for cabinet positions and was brought "whole binders full of women." Within hours, the remark became prime fodder for satirical social media accounts. Never mind that Boston Phoenix's David Bernstein fact-checked...

Horrorfind Weekend 14
Once again Labor Day weekend rolled around and it was time for another trip to Gettysburg, Pennsylvania for the Horrorfind Weekend Convention.
The convention combines all things horror—books, movies, collectibles, etc—and that’s what I really enjoy about it. Last year I had a blast, getting to meet authors I knew online in person and hang out with friends who live in other parts of the country but gather in Gettysburg once a year.
This year’s movie guests included Malcolm McDowell (A Clockwork Orange {1971}, Halloween {2007}, and Adult Swim’s Metalocalypse), Ray Wise (Robocop {1987} and David Lynch’s Twin Peaks), Doug Bradley (the Hellraiser series), Mary Woronov (The House Of The Devil {2009}, Eating Raoul {1982}, Death Race 2000 {1975}) and Patty Mullen (Frankenhooker {1990}).
There were quite a few authors representing the small horror press Samhain Publishing, including John Everson, Brian Moreland, David Bernstein,...

Those who’ve held out hope to see David O. Russell‘s Nailed — if such people actually do exist, that is — might want to turn back and pretend the following story just doesn’t exist. But, here we go: Collider spoke to the film’s producers, Douglas Wick and Lucy Fisher, who helped pinpoint where, exactly, things went wrong with their production.
Problems kicked off when financiers David Bernstein and Ron Tutor ended up being financially incompetent, unable to keep the lights on; they claim to have gone “with a financier of questionable integrity that turned out to be of no integrity whatsoever and just had no intention of paying the bills, and he didn’t.” It led to fourteen (fourteen!) halts in production and post-production, with the final stop taking place right before the most important scene could be done.
Read a quote on it below:

London, July 7: A forensic psychologist has sensationally claimed that a check signed by Marilyn Monroe the day before her death proves she was not planning to kill herself.
The actress had used the check, which is now being auctioned off, to purchase a white chest of drawers worth 228.80 dollars from Pilgrim's Furniture, an act Harvard-trained Dr S. David Bernstein believes is inconsistent with someone contemplating suicide.

A check signed by Marilyn Monroe on the day before her death suggests a low likelihood that the actress was contemplating suicide, according to Dr. S. David Bernstein, a Harvard-trained forensic psychologist and head of the Connecticut-based Forensic Consultants LLC. The check is about to be auctioned off in Beverly Hills by Heritage Auctions, part of a 15-lot collection of items commemorating the life of Marilyn Monroe.
The $228.80 check, which Monroe used to pay for the purchase of a white chest of drawers from Pilgrim's Furniture, was dated Aug. 4, 1962, the day before her death. Her death was was ruled a probable suicide. But according to Bernstein, who did not receive compensation for his analysis, there is something about the behavior that is inconsistent with someone planning their suicide.
"People about to kill themselves frequently engage in self-soothing behaviors," he told The Huffington Post. Shopping sprees are definitely one of those behaviors,...

In the wake of accusations of racism, Chelsea defender John Terry has been stripped of the England captaincy. The Chelsea defender was apparently informed of the decision by the Fa’s chairman David Bernstein over the phone at 10am this morning, after he consulted with the other board members over the right course of action.
The Fa’s decision appears, at this stage to be extremely self-serving, given that Terry has not yet been removed from the England set-up permanently. The board are treading the middle ground, allowing Terry to remain available in the interest of the national team at the same time as appearing to punish the player for bringing the Association into disrepute (again). But that’s not to say Terry will definitely still play this summer – despite the assertions of manager Fabio Capello that he would not rule Terry out as long as he remained unconvicted.
