Rupert Murdoch, Lachlan Murdoch, Fox Corporation board member Paul Ryan and Fox Corp. executive Viet Dinh can be compelled to testify in Dominion’s upcoming defamation trial against Fox News, a judge said on Wednesday.
Delaware Judge Eric M. Davis said that Dominion would have to issue a trial subpoena to force such live testimony, but he would not quash it over issues of inconvenience or because they previously have sat for depositions. Davis cited court precedent that officers, directors and managing agents of a Delaware corporation can be compelled to appear.
“Both Fox and Dominion have made these four parties very relevant,” Davis said.
He added, “If Dominion wants to bring them live, they need to do a trial subpoena and I would not quash it and I would compel them to come.”
He also cited issues with Rupert Murdoch’s deposition and whether questions asked of him were clear or unfairly prejudicial.

Fox News Media said it has parted ways with legal analyst Andrew Napolitano, following an associate producer’s claim of sexual harassment.
The employee, John Fawcett, who works on Fox Business Network’s Kudlow, filed a lawsuit Monday in New York Supreme Court (read it here) against the network, outlining his claims against Napolitano.
Fawcett also alleged that Larry Kudlow, the host of the show, has used ethnic slurs and made sexually inappropriate comments about women “in front of multiple staffers,” including himself and a senior vice president. He also claimed that Kudlow nixed the appearance of Rep. Byron Donalds (R-fl) on the show because of his race.
In a statement Fox News Media said: “Upon first learning of John Fawcett’s allegations against Judge Andrew Napolitano, Fox News Media immediately investigated the claims and addressed the matter with both parties. The network and Judge Napolitano have since parted ways.

The opinion hosts at Fox News Channel and Fox Business Network have always been good at tripping liberal sensibilities. In the last few days, however, some of them have drawn criticism from an even wider circle.
On Monday morning, “Fox & Friends” co-anchor Brian Kilmeade stirred up social-media reaction with some remarks about a caravan of migrants that has been making its way up through South America toward the United States and which has become a cause celebre in remarks from President Donald Trump and various Republicans. “What about diseases? There is a reason you can’t bring a kid to school unless he is inoculated,” said Kilmeade. “There are things that happen in this country. We already give 40 to 50% of our taxable income to the government for social programs is it too much to say we just can’t have country’s entire populations come in here without being looked at as hard-hearted.

Joe Scarborough accused Fox News on Monday morning of playing a direct role in inspiring extremists like Robert Bowers, who is accused of murdering 11 people at a Pittsburgh synagogue on Saturday.
“People on Fox News that talk about the caravan as if this is a big election issue know it’s a lie, know it’s 1,000 miles away. [They] know that the last caravan that they whipped up a frenzy about actually only brought 14 arrests by the end of the caravan.” said Scarborough on “Morning Joe.” “They are spreading hatred across America and at the end of the day … inspiring people like this Pittsburgh mass murderer.”
Mika Brzezinski was broadly in agreement with her co-host.

Fox Business Network is pulling an already aired episode of Lou Dobbs Tonight from reruns or any online archives because of perceptions created by a guest’s remarks about activist George Soros.
In a Thursday broadcast, Chris Farrell, head of the conservative activist Judicial Watch organization, said that Soros and a “Soros-funded State Department” are financially backing the so-called migrant “caravan” that is heading toward the Us border from Mexico.
Some observers believed the remarks were an anti-Semitic conspiracy theory dog whistle on Soros, who is Jewish, and revives Fifth column canards about Jewish plots. The condemnations of Farrell’s remarks gained steamed in the wake of heightened sensitivities following the Pittsburgh Synagogue massacre on Saturday.
Judicial Watch has extensively covered the migration, including video footage and on-the-ground coverage. The site’s stories largely claim the mainstream media is not portraying the motivations of the migrants accurately.

An executive from Fox Business Network said the cable outlet would pull from rotation a recent broadcast of “Lou Dobbs Tonight” featuring a guest making remarks about a “Soros-occupied State Department” that has spurred social-media pushback in the wake of Saturday’s shooting tragedy at a Pittsburgh synagogue.
“We condemn the rhetoric by the guest on Lou Dobbs Tonight. This episode was a repeat which has now been pulled from all future airings,” said Gary Schreier, senior vice president of programming at the 21st Century Fox-owned network, in a statement. The decision comes after Dobbs posted — and then deleted — two different tweets last week suggested recent bomb threat made to media outlets and Democrats were false.
