In order to arrest a person, police must have probable cause. Nothing that Snake did, said, or didn't say came anywhere near giving police probable cause to arrest him. Even though police may consider him the primary suspect in the case, they cannot arrest him simply because they believe he probably committed the crime, especially since they haven't yet interviewed his wife (the victim) and have no physical or eyewitness evidence that points to his guilt--or even to his presence at the crime scene.
