Having sexual intercourse with someone who is severely intoxicated, but still conscious, is not rape in the first degree, it is actually rape in the second degree. New York Penal Code, Article 130, Section 30, Subsection 2 states: "A person is guilty of rape in the second degree when...he or she engages in sexual intercourse with another person who is incapable of consent by reason of being mentally disabled or mentally incapacitated." Being intoxicated is the same as being mentally incapacitated. In order for rape in the first degree to be charged the victim must be "physically helpless", or in other words unconscious.
The order of the slapping scene should be: Stone is approached by Sarah Kent in a bar and is asked by her "You don't remember me, do you?" and replies with a smile and giggle, then Sarah Kent slaps him. Instead Sarah's hand raise, the subtitles state (BLOW LANDS), but Sarah's hand never actually hits Stone's face, and he moves his face away, appearing shocked at being slapped.
