Continuity

When Olivia picks up the box Jones left for her, she is wearing a black striped shirt. She goes right to Walter's lab, where she is seen wearing a maroon shirt. In the same scene, she sits down with the light box and is wearing the black striped shirt again.

Factual errors

When Harris interviews David Robert Jones during the absence of all the other agents, he is genuinely upset about Jones unwillingness to cooperate. As revealed later, Harris works for Jones. It seems nonsensical that Harris would interview (his boss) Jones in such a matter. Instead, Harris should have helped Jones "activate" the other cortexiphan subjects, as he did in other occasions.
Mr. Kohl says "The best we can hope for is life". Lifelong imprisonment is the maximum penalty in Germany. The death penalty does not exist anymore since 1949. Also the extradition of a prisoner, who has to expect death penalty in the receiving country, is forbidden by German law and so not possible. So the sentence of Mr. Kohl makes no sense.

Crew or equipment visible

At about 7:28 when Olivia is interviewing Loeb, there is a microphone (with red tape) near the bottom of the screen.

Character error

Besides the fact that the German guards speak the language extremely poorly, some words and/or articulations are not commonly used in German language and sound extremely cliché (i.e. the translation of 'Sir' to 'Mein Herr').
