The teenagers accused of beating the victim to death, and then setting him on fire, are charged with robbery in the first degree and murder in the second degree. However the especially brutal circumstances of the victim's death constitute a higher charge. The victim was killed during the commission of an armed robbery, was severely beaten and then set on fire. Intentionally killing someone during the commission of a violent felony, and killing someone in a cruel and wanton manner to make them needlessly suffer, both constitute murder in the first degree. If the defendants are convicted of murder two they would get a life sentence, but they could paroled after 15-25 years; whereas with murder one they would be required to serve a minimum of 25 years and they could also be sentenced to life without parole.
