The elderly pound-owner initially refers to Maxine as "he" when speaking to J.D. on the phone, but then later correctly refers to the dog as "she" and "her". The dog had been at the pound for quite a while before Boss's call, so the pound-owner would have had plenty of chance to inspect the dog and correctly ascertain its gender.
