Convicted fraudster ordered to repay around $230m to investors.
A man who has played small roles in Hollywood films has been sentenced to 20 years in prison for running a Ponzi scheme that duped investors out of $650m.
The prosecution said Zachary Horwitz obtained loans for his company 1inMM Capital from 2014-2019 by claiming he was raising funds to buy film rights that would then be licensed to streamers like Netflix and HBO.

Updated with sentencing: Zachary Horwitz, the Hollywood actor who pleaded guilty last fall for operating a Ponzi scheme that bilked $650 million from investors who thought their money would be used to acquire licensing rights to films, was sentenced to 20 years in prison Monday.
U.S. District Judge Mark C. Scarsi also also ordered Horwitz to pay $230,361,884 in restitution to his victims. Horowitz, whose screen name was Zach Avery, pleaded guilty in October to one count of securities fraud after his arrest in April 2021.
His scheme went on for more than five years, with Horowitz raising millions of dollars from investors — some personal friends– by telling them their money would be used by his company, 1inMM Capital, to acquire film distribution rights in foreign territories, which then would be licensed to online platforms like Netflix and HBO. None of that ever actually happened, with the documents faked and the money instead...

A hard-boozing caseworker grimaces his way around St Louis in Michele Civetta’s overblown urban thriller
Not quite credible enough to stand up as a gritty, 70s-esque social drama, and lacking the focus of the Training Day-style urban thriller it’s marketed as, Michele Civetta’s second feature is an awkward but passably entertaining blend of both. The Gateway is the nickname for the Missouri city of St Louis, rough terrain shepherded by seen-it-all social worker Parker (a lead role for blockbuster fringe player Shea Whigham). Sipping Jameson miniatures as he does his rounds, he becomes particularly concerned about Dahlia (Olivia Munn) and Ashley (Taegen Burns), after the latter’s dad Mike (Zach Avery) is released from prison.
Civetta, who also co-wrote, is not one for understatement. Not only is Parker a hard-boozing caseworker, he’s also an orphan (abandoned by Bruce Dern’s jazz-trumpeter dad) as well as a former prizefighting champ.

I have been known from time to time watch a flick based solely on its cast. Take Sam Rockwell for instance, the trailer could be awful but I’m still going to watch it because it’s Sam ‘freaking’ Rockwell. Recently Frank Grillo has made his way onto this list after a string of spot on supporting roles and the odd leading man performance… So you can imagine my giddy glee to see the man teaming up with The Newsroom‘s Olivia Munn for an “action thriller” romp. The movie is called The Gateway and I’m about to get into it for you all right now!

“The Gateway” is an inner-city neo-noir thriller starring Shea Whigham as Parker, a social worker assigned to the care of the daughter (Taegen Burns) of a single mother (Olivia Munn). But when the dad (Zach Avery) returns from prison, all hell breaks loose. I spent some time with “The Gateway” director Michele Civetta to

Set in St. Louis but shot in coastal Virginia, attempting to wrestle tough sociopolitical issues while sporting the neon hues of a stylized neo-noir, “The Gateway” lets itself get pulled in too many directions for any of them to be well-realized. Nonetheless, this crime melodrama represents an advance for commercials and music video director Michele Civetta over his first feature, the occult muddle “Agony,” with improved control over performances and pacing. The implausible but diverting Lionsgate release is launching in limited theaters, on demand and digital Sept. 3, with disc formats following a week later.

Zachary Horwitz, known in Hollywood as actor Zach Avery, has been arrested for allegedly running a multi-million dollar Ponzi scheme disguised as an investment to acquire licensing rights to films for distribution abroad. On Tuesday, actor Zachary Horwitz (known professionally as Zach Avery) was arrested on charges of wire fraud, as reported by the Los Angeles Times.
The FBI and SEC allege that Horwitz ran a Ponzi scheme through his company, 1inMM, which defrauded investors of $227 million.
Allegedly, Horwitz told investors that his company invested in film rights, subsequently reselling these rights to distributors like Netflix and HBO. He is said to have sold people on his scheme by showing them fake licensing and distribution agreements, featuring forged signatures. Ultimately, however, both of the above companies confirmed to the FBI that they’d never conducted business with 1nMM.
It is believed that Horwitz began receiving funds as part of the Ponzi scheme in 2015, using them to purchase a $6 million home in the Beverlywood neighborhood of Los Angeles, while repaying earlier investors.
Horwitz’s credits as an actor include low-budget features such as Trespassers and The Devil Below.

Actor and movie investor Zachary Horwitz, who is sometimes credited as Zach Avery, was arrested Tuesday on charges that he ran a Ponzi scheme that swindled investors out of $227 million.
Horwitz, 34, was taken into custody by special agents with the FBI, the U.S. Attorney’s Office reported. Horwitz claimed investors’ money would be used for buying rights to films that HBO and Netflix had signed on to distribute internationally, particularly in Latin America.
Horwitz appeared Tuesday in United States District Court on a charge of wire fraud, which carries a statutory maximum penalty of 20 years in prison.
The complaint alleges that Horwitz solicited investors for his company 1inMM Capital LLC, saying he would purchase the regional distribution rights to films and then license the rights to platforms including Netflix and HBO. Director Eduardo Rodriguez has been, at least for me, something of a underrated talent. His first Hollywood movie, Stash House, was an effective action thriller and his follow-up, El Gringo, was a superb film and star-making vehicle for action star Scott Adkins. And – at least for me – his Fright Night sequel-c0me-remake was a decent entry in the franchise and one that I enjoyed more than the Colin Farrell iteration. So when I discovered his latest feature film, You’re Not Alone, was due out this week – after apparently being filmed in 2016 under the title Unwanted – I knew I had to check it out… And I’m glad I did.

This identity thriller suffers from overreliance on coincidences and perplexing cameos from Brian Cox and Udo Kier
Brothers Colin and James Krisel and/or actor Zach Avery must be either very well financed or ridiculously persuasive because they’ve managed to pull together a supporting cast and budget for this debut thriller that far exceeds what the script seems to warrant. At heart, Last Moment of Clarity is a slight, imaginatively thin B-movie which doesn’t so much as allude to Alfred Hitchcock’s Rear Window and Vertigo as outright steal from them brazenly, ending up with a limp neo-noir that unfolds in the streets of Paris and classy apartments in Los Angeles. There are cameos from Brian Cox and Udo Kier, both great scene-stealing actors with many virtues other than accent mimicry, judging by the bizarre Scots-French mashup Cox tries out here that is only a hair’s breadth...

"It took my son, and I've been fighting him ever since." Vertical Ent. has released an official trailer for The Devil Below, a new horror film (formerly titled Shookum Hills) from filmmaker / VFX supervisor Brad Parker (director of the very creepy Chernobyl Diaries previously). A geological expedition to an Appalachian sinkhole becomes a fight for survival against a mysterious force. When a team of researchers try to find out how fires started in underground coal mines that have been ablaze for decades, they encounter something much more frightening hiding within. The film stars Alicia Sanz, Adan Canto, Zach Avery, Chinaza Uche, Jesse Latourette, Jonathan Sadowski, and Will Patton. The best part about this is definitely the grizzled Will Patton. It looks a bit like Tremors meets The Descent, which is kind of a thrilling mash-up. Here's the official trailer (+ poster) for Brad Parker's The Devil Below, direct from Vertical's YouTube...

MGM has bought the Johnny Depp drama “Minamata” and has set an awards-season release of Feb. 5, 2021, through its revived American International Pictures label.
MGM also acquired all rights to “Minamata” in Canada, Germany and Switzerland. The film premiered at the Berlin Film Festival in February.
Set in 1971, Depp portrays photojournalist Eugene Smith, who’s become a recluse and disconnected from the world he once shot. After receiving one final assignment from Life Magazine editor Robert Hayes (played by Bill Nighy), he must travel to the Japanese coastal city of Minamata, which has been ravaged by mercury poisoning. Assisted by an impassioned Japanese translator and encouraged by local villagers, his powerful images expose decades of gross negligence by the country’s Chisso Corporation.
“Minamata” also stars Jun Kunimura, Ryo Kase, Tadanobu Asano and Akiko Iwase. Andrew Levitas directed the film from a screenplay by Levitas, David K. Kessler, Stephen Deuters and Jason Forman.

"I just have to know if it's you!" Lionsgate has unveiled an official trailer for a mystery thriller titled Last Moment of Clarity, the feature directorial debut of brothers Colin & James Krisel. A normal New Yorker's life is upended when his girlfriend is murdered by the Bulgarian mob. He flees to Paris to stay safe. Years later, he sees a similar looking woman in a movie. Obsession with past love takes Sam to Los Angeles to look for answers, only to put him back into the sights of the Bulgarians. Described as an "updated Hitchcockian thriller in the vein of Vertigo and Rear Window," it "will keep you guessing until the final frame." Starring Samara Weaving and Carly Chaikin as the two main women, with Zach Avery, Udo Kier, Brian Cox, Hal Ozsan, and Pasha D. Lychnikoff. No surprise, this trailer gives away a lot to get you more curious.

You might be used to seeing Janel Parrish play Mona in Pretty Little Liars: The Perfectionists and Margot in To All the Boys I've Loved Before, but the 30-year-old actress enters different territory in her new film Trespassers. The horror film, directed by Orson Oblowitz, centers on two couples - Estelle (Parrish) and Victor (Jonathan Howard), as well as Sarah (Angela Trimbur) and Joseph (Zach Avery) - who are experiencing relationship problems and decide to rent an Airbnb in the desert for a temporary getaway. But the arrival of a mysterious woman (Fairuza Balk) leads to death and chaos as the four friends are forced to fight for their lives against home invaders.
For Parrish, the dark thriller was easy to get behind after she read the script. "I thought it was really interesting, and the whole Airbnb aspect of it is so terrifying to me," she said. "It could...

Interview: Director Orson Oblowitz on the Challenges and Lessons He Learned While Making Trespassers
Set to hit theaters in Los Angeles and New York tomorrow is Orson Oblowitz’s home invasion thriller Trespassers, which stars Angela Trimbur and Fairuza Balk (two of this writer’s favorite actresses), as well as Zach Avery, Janel Parrish,g and Jonathan Howard. The story follows two couples who Airbnb a house in the middle of the desert for a weekend to try to work out their respective issues, but things go horribly awry once they find themselves in a fight for their lives.
Daily Dead recently chatted with Trespassers director Orson Oblowitz about his initial interest in taking on the project, as well as the casting process, the challenges of creating the film’s visual style, how working on the project transformed him as an artist, and more.

A weekend getaway goes sour even before the corpses start accruing in “Trespassers,” a good-looking indie thriller that’s diverting, but could have used another script draft or two. Depicting two quarrelsome if hard-bodied couples who find themselves in deep peril at a rented desert home, Orson Oblowitz’s film has a leisurely enough buildup that room should have been made for more fully developed characters. Fine-tuning the pileup of eventual violent crises wouldn’t have hurt, either. The result falls short of being especially credible, let alone memorable. Still, this is a polished genre exercise that provides a decent night’s home entertainment. IFC Midnight is opening it July 12 on screens in New York and Los Angeles, simultaneous with its launch on demand.

The film opens on an affluent white couple living close enough to the Mexican border for another character to later say, “You can’t open the door to strangers in today’s society.” They’re awoken by three men in masks made to look like Ms-13 gang members, dragged out, and put in the trunk of a car before being shot dead by the side of the road. The Maga allusions are therefore present from the start with pretty Malibu types falling victim to violent “cholos” for what appears to be no other reason besides the bloodlust Fox News’ fear-mongering editorials have told conservative Boomers is coming if they don’t remain vigilant. We eventually discover they’re actually after a photograph, but that’s just an excuse to let these racist stereotypes shine.
I say this because writer Corey Deshon and director Orson Oblowitz never provide a motive beyond terror in Trespassers.

"Sometimes you just can't stop what's coming..." IFC Midnight has released an official trailer for an indie horror film titled Trespassers, the latest from filmmaker Orson Oblowitz (The Queen of Hollywood Blvd). The home invasion horror premiered at FrightFest London last year, and also played in Germany's Fantasy Filmfest. Two couples rent a modern luxury desert home for the weekend hoping to sort out their messed-up lives. Just as they are about to settle in, a woman shows up at their door. And that's when the murderous trouble really starts. Because without knowing it, these four friends have just landed slap-bang in the wrong violent place at precisely the wrong bloody time. Starring Angela Trimbur, Zach Avery, Janel Parrish, Jonathan Howard, Fairuza Balk, Carlo Rota, Sebastian Sozzi, and Joey Abril. This seems so much like a been-there, done-that horror rehash pulling from You're Next and everything else we've already seen.

It’s been a week of grief and mourning for Helen (Lyndsy Fonseca) after finding her husband Wells (Noah Bean) dead by suicide at their secluded cabin. She’s dealing with his absence like anyone would by closing off spaces they shared together in hopes of avoiding too many easy triggers for memories that only bring sadness. Work should distract her during the day and Wells’ business partner Tomas (Glenn Morshower) continuing their secretive scientific research should honor his legacy. This doesn’t mean she’ll forget him, forgive him, or stop blaming herself for missing the signs of his pain, but they say life will eventually go on. What they don’t say, however, is that you just might awaken one morning with no recollection of multiple days since you fell asleep.
They don’t because that doesn’t happen in the real world — at least not without the help of some heavy drugs.

"Why do you think Wells was so secretive about his work?" Screen Media has unveiled a trailer for indie sci-fi thriller Curvature, which premiered at the Sitges Film Festival last year. Co-starring Linda Hamilton, Glenn Morshower, Alex Lanipekun, Zach Avery, Noah Bean. I saw this at Sitges and unfortunately it's not good.
