The entire plot line concerning the Power of Attorney is factually inaccurate. A Power of Attorney can only be signed by someone who has legal capacity to execute one. In this case, if the daughter lacks capacity, she couldn't have executed a valid Power of Attorney in the first place. If she has capacity, then there is no way her mother can overrule or override her wishes, by reliance on the Power of Attorney, which the daughter could simply revoke on the spot. See more »
