Character error 

Referencing the board game Monopoly, Ted says he got $50 for winning second prize in a beauty contest. In the actual game, the player collects only $10 for that.

Tom Brady lives in Newton, Massachusetts, but a Boston Police cruiser from Area A responds to the break-in call. Area A covers downtown Boston, East Boston, and Charlestown.

The drive from Boston to New York City is only about 3.5 hours, yet is portrayed in the film as an all-day trip (They leave in the morning, stop for lunch, then Ted wrecks the car that night). Furthermore, the Millpond Diner is in Wareham, MA, near Martha's Vineyard - the opposite direction than they would take from Boston to NYC.

The errors in legal procedure as portrayed in the courtroom scenes are too numerous to mention, but a few stand out. In a civil trial, the plaintiff gives the first opening statement, followed by the defense; in the film the defense goes first. Both opening statements shown in the film were argumentative, and in a jury trial would have been properly objected to and stricken. The appeal would not have been in front of a jury; they are decided by judges only.

Plot holes 

If the Commonwealth of Massachusetts considered Ted property rather than a person, then his arrest record and any convictions would actually be invalidated and couldn't be used against him - "property" can't be convicted of a crime.

Similarly, they wouldn't have any jurisdiction over his employment status at the grocery store and would have no say over whether he could maintain employment there or anywhere else. The grocery store wouldn't be bound by any employment laws which apply to people. They could enter into any agreement with Ted (or his owner) under any terms they wanted because the employment laws wouldn't apply.

Sam asks, "Who's Gollum?" because she's "pop culture illiterate". However, Sam knows F. Scott Fitzgerald, so she should be well-read enough to know who Gollum is from the book version of Lord of the Rings.

Even if the core narrative that the film presents ( that Ted is not alive, but is property) is true, then he would belong to either John or Tami-Lyn. The company that sold him to John's parents (and thus John) would have no claim over Ted and any case would be dismissed quickly if it was even brought.

The 2015 Comic Con sequence looks like the 2014 Comic Con. Displays for My Little Pony: Equestria Girls - Rainbow Rocks do not match the 2015 setting. Product placement of My Little Pony: Equestria Girls - Friendship Games would've been displayed by then; but that didn't exist when the movie was being filmed.
