- TriviaArticling, in Canada, is a 10-12-month process between law school graduation and being called to the bar. Articling requirements vary in every province.The idea behind articling is that academic training alone is insufficient. Articling is a period of experiential learning meant to assist in the transition from law school to the actual practice of law. Freshly minted law graduates must learn from established lawyers (or from judges, if they are awarded court clerkships) in order to be licensed to practise law in their jurisdiction. Articling can occur in a law firm, in-house (corporation, union, etc.) or government setting. During articling the goal is to provide each articled clerk with an opportunity to gain experience in a variety of relevant areas, including (but not limited to) professional responsibility, personal practice and office management, interviewing and advising, negotiation and advocacy. A clerk's work must be supervised by other lawyers, who provide constructive feedback and assist them in learning legal practice and client management skills. After articling, there is a process called "hire back", when the employer determines whether or not to retain the newly called lawyer's services. At large Canadian firms, this can be a time of significant stress from those wishing to remain with the firm. Some other employers expressly state that the articling student will not be hired back. Employers who do not hire back their articling students often assist those students in finding employment as new lawyers. There is no way in Canada to be called to the bar of any province other than through articling or an equivalent (Law Practice Program, clinic-based law school).
In the United Kingdom on the other hand, "articling" is what we used to call the "training contract" for solicitors. It is a two year period after you pass the LPC (Legal Practice Course) where you practice under the supervision of more senior solicitors before you are admitted to the roll in your own right. During that stage you used to be called an "articled clerk" which led to the phrase "articling".
