Continuity 

In "The Fight" it's revealed that Marshall and his brothers use to have crazy fights. However, in "The Sweet Taste of Liberty" (1.3), Marshall says "Oh Thank God, I've never been in a fight before." in the scene where he thinks a guy is hitting on Lily.

In the episode How I Met Your Mother: The Sweet Taste of Liberty Marshall said:"... oh thanks, I've never been in a fight before", but in this episode he says that he and his brothers always had fights. Also in that episode he was scared of fighting, but in this episode he wasn't.

Factual errors 

"The State" doesn't sue people on criminal matters. The State doesn't serve people with papers. The State arrests people, arraigns them in court and then everybody waits for trial.

People sue on Civil matters. People are served with papers from process servers. There is no jail time in Civil suits.

Marshall, the attorney, intentionally exaggerates the penalties for the criminal charges. 2030 Ted explains what the real penalties are for assault charges. But again, it is a Civil suit and not a criminal matter. The only penalty is monetary awards.
