"Sodomy in the first degree" is not a criminal charge in the state of New York. Sexual crimes that involve anal penetration can fall under a few different categories: anal sexual intercourse without consent is charged as "criminal sexual act"; anal penetration with a finger or foreign object without consent is charged as "sexual abuse"; anal penetration with a finger or foreign object without consent that causes physical damage is charged as "aggravated sexual abuse". Each of these charges have three degrees of severity which is determined by several factors including lack of consent due to the victim being a minor, the victim being mentally or physically incapacitated and/or the victim being forced to allow the act to occur.
