Quotes

  • Aaron Wallace : One more time Mr. Yamada, were you aware of the second lineup when you offered my client the plea deal?

ADA Adam Yamada : I decline to answer that question on the grounds that it may incriminate me.

Aaron Wallace : When you realized that the NYPD had conducted two lineups rendering this entire prosecution bogus, surely you must have had a reaction?

ADA Adam Yamada : I decline to answer that.

Aaron Wallace : Why didn't you dismiss the case Mr. Yamada?

ADA Adam Yamada : Again I take the fifth.

Aaron Wallace : Did you personally make the decision to offer the plea?

ADA Adam Yamada : I already told you, I take

Aaron Wallace : Okay, let's try it this way. Does a line assistant in the Bronz DA's office have the authority to make an offer on violent felony cases without consulting a supervisor? Nothing in this question implicates you Mr. Yamada, so I am going to ask you again, at the time my client took the deal, did you have the authority to make plea offers on violent felony cases?

    ADA Adam Yamada : No.

Aaron Wallace : You had to go to your bureau chief, right?

    ADA Adam Yamada : Generally.

Aaron Wallace : Can you name a single B violent felony case where you alone made a plea offer without consulting your bureau chief?

    ADA Adam Yamada : No.

Aaron Wallace : And the bureau chief of trial zero-thirty on August 28, 2015, the day you offered my client the deal, who was that?

ADA Adam Yamada : It was Dez O'Reilly

Aaron Wallace : And do you believe that Mr. O'Reilly would have offered a plea deal under these circumstances if he felt that it violated the practices and policies set forth by the District Attorney that you both worked for?

    ADA Adam Yamada : I don't know.

Aaron Wallace : In your years of working with Dez O'Reilly, have you ever known him to undermine the practices or policies of the District Attorney?

    ADA Adam Yamada : No.

Aaron Wallace : So it would be safe to assume that when Dez O'Reilly tells you to do something, that he is doing it with the understanding that this is what the District Attorney, Mr. Glen Maskins wants?

Jill Murray : My client would like a five minute bathroom break please.

  • Aaron Wallace : You're about to offer me something.

Dez O'Reilly : You only brought the civil suit so you could get this deposition, bring it back to criminal and file it for public record, which is why we are going to offer your client $100,000 settlement. I know that's not something you want to bring to him, but we'd all rather he stayed behind bars so that this doesn't happen for a while. And you are obligated to bring him that offer, as his attorney. We find out you didn't, it'd be pretty easy to have you disbarred.
