Own the rights?
That depends on your definition of sequel. The events of this film take place alongside the events in Night of the Living Dead (1968) (even though the new film is set in 2008). What's certain is that Diary of the Dead is the fifth film in George Romero's series.

Anyone who dies comes back as a zombie, unless his brain is destroyed. It doesn't matter if the dead person had suffered a gunshot wound, a car accident, a paper cut: anyone who dies with an intact brain will reanimate a short while later. The 'Dead' movies never explain why this is so--although the characters in the movies have their theories..
