Collins should be charged with 53 counts of murder in the first degree, not murder in the second degree. In most states premeditated murder is charged as first degree murder, however in New York it is usually charged as aggravated murder in the second degree. In New York the charge of murder in the first degree is reserved for very specific types of murder, the most common being the murder of a police officer. If a murder is committed during the commission of, or in furtherance of certain crimes, like arson in the first degree, then it becomes murder in the first degree. See more
