Like much of the series it is inspired by the American Civil War, a term for bands of guerillas sponsored by both sides to raid behind enemy lines. In reality these were little more than state sponsored brigands who looted and pillaged at will. The most famous Bushwhacker of all was Jesse James who refused to accept the war was over and continued to rebel against the government and commit robberies, much like Mal does.
