The film was made way back in 2006 and left on the shelf at New Line, destined not to see the light of day until Warner Bros. picked up New Line's content.
In 2001, Mark Wahlberg and Hugh Jackman were in talks to star. Production was scheduled to begin in February 2002. After the September 11, 2001 attack on New York City and the celebrated heroics of the city's police, however, it was deemed inappropriate to make a film featuring corrupt NYPD officers at the time.
Nick Nolte was originally cast as Francis Tierney, Sr., but an old knee injury flared up and Nolte found himself unable to perform when he came to the set.
Gavin O'Connor did rewrites on the script throughout the filming process.

Colin Farrell (Jimmy Egan) and Frank Grillo (Eddie Carbone) both also starred in Minority Report (2002) and Grillo and Noah Emmerich (Francis Tierney, Jr.) both starred in Warrior (2011) as well.

The trivia item below may give away important plot points.

Jimmy's (Colin Farrell) death scene was originally supposed to have Ray (Edward Norton) let him go into the crowd to be accosted by the angry mob and then the audience would assume that he died. Director Gavin O'Connor knew he needed a more powerful ending and decided to have Jimmy be beaten to death in front of Ray to add a sort of sympathy for the character Jimmy.
