When director F.W. Murnau signed with Fox Pictures, he wanted this project to be his first film for the studio. Fox bought the rights to the novel but it soon became clear that Murnau's concept of a lengthy location shoot in Alaska would not be financially feasible. He was, instead, assigned SUNRISE as his first American film. FROZEN JUSTICE passed first to John Ford then, eventually, became a talkie directed by Alan Dwan.
