The parents of slain Democratic National Committee staffer Seth Rich prevailed in an effort to sue Fox News Channel over allegations that employees of the network helped promote unproven theories the young man’s death was tied to a leak of emails from the DNC to WikiLeaks in 2016.
The Court of Appeals for the Second Circuit on Friday reversed a lower court decision to dismiss the case, and now Joel and Mary Rich can continue pursuing legal remedy for what they allege includes intentional infliction of emotional distress, tortious interference with contract and negligent supervision.
“This decision now clears the way for a thorough investigation into the facts,” said Lenny Gail, an attorney for the Rich family. ” We will now obtain documents from Fox News and other parties and take testimony under oath from those involved.”
Rich was killed in 2016, and Washington, D.C. police have determined he was shot during a robbery.

The parents of Seth Rich, the Democratic National Committee staffer murdered during a botched robbery in 2016, won a legal effort on Friday to revive a lawsuit against Fox News, reporter Malia Zimmerman and guest commentator Ed Butowsky centering on a conspiracy theory that was published about the case.
The Court of Appeals for the Second Circuit ruling revived the Rich lawsuit, reversing a lower court decision to dismiss the case.
“We conclude that these allegations plausibly state claims for intentional infliction of emotional distress and tortious interference with contract, and that they are capable of supporting claims of negligent supervision,” according to an opinion written by Guido Calabresi, who was joined by two other judges in the decision. Nearly half a year after the parents of Seth Rich went after Fox News Channel for damages caused by an admittedly false report about the murdered Democratic National Committee staffer, Joel and Mary Rich were told today by a federal judge that heartbreaking grief is not enough under the law.
“It is understandable that Plaintiffs might feel that their grief and personal loss were taken advantage of, and that the tragic death of their son was exploited for political purposes,” District Judge George Daniels said in his decision and order over their intentional infliction of emotion distress filing of mid-March over postings and stories by Fnc about their child that started in May 2017. “However, a general allegation that Defendants had an ‘agreement to collaborate against’ Plaintiffs cannot form the basis of an Iied claim,” he added (read it here). “Plaintiffs’ complaint is dismissed in its entirety.”

A federal judge has dismissed a lawsuit brought against Fox News by the parents of slain Democratic National Committee staffer Seth Rich, finding that the suit did not meet the legal requirements to proceed.
Joel and Mary Rich sued the network in March, accusing it of fabricating a story that accused their son of conspiring with WikiLeaks. The suit alleged intentional infliction of emotional distress, interference with a contract, and negligent supervision.
In his ruling on Thursday, Judge George Daniels found that the complaint failed to satisfy the elements required under federal law.

Fox News has agreed to pay $10 million to settle discrimination cases with 18 former employees, putting to rest most of the litigation that followed the high-profile departures of Roger Ailes and Bill O’Reilly over the last two years.
One of the cases was a class action with 11 plaintiffs who alleged that the network engaged in racial discrimination. Another involved a radio correspondent who alleged she was fired for complaining about gender discrimination, while in another case a Fox 5 correspondent accused the network of pregnancy discrimination.
Douglas Wigdor, the attorney who represented the plaintiffs, issued a joint statement Tuesday with Fox News: “The parties have reached mutual agreements that resolve various cases involving former Fox News employees.”

After Seth Rich, a staffer at the Democratic National Committee, was murdered in July 2016, Fox News published an article that suggested that he was responsible for leaking DNC emails to WikiLeaks.
