Tom Cruise's 'The Last Samurai' wins plagiarism case

Producers and writers Marshall Herskovitz and Ed Zwick have won in a court trial after accusations of stealing the script for the Tom Cruise drama The Last Samurai. Aaron and Matthew Benay filed suit in 2005 against the producers claiming that it was based on their script, also titled The Last Samurai. The brothers alleged that they submitted the screenplay in 2000 to Bedford Falls, Herskovitz and Zwick's production company, three years before The Last Samurai was released. Both iterations of the script are about an American war veteran who trains the Japanese Imperial Army in the methods of Western warfare. Producers Win Last Samurai Court Case

Producers behind Tom Cruise's 2003 blockbuster The Last Samurai have won a legal battle against two screenwriter brothers who alleged their idea for the film was stolen.

Writers Aaron and Matthew Benay filed suit in 2005, insisting a script they wrote in 2000, also called The Last Samurai, was used as a template for the hit Cruise movie.

Film executives Marshall Herskovitz and Ed Zwick disputed the brothers' claims that they had sent a script to their production company Bedford Falls, and, after a seven-day jury trial in Los Angeles, they were vindicated of the accusations on Friday.

Herskovitz tells The Hollywood Reporter, "Ed and I are extremely relieved. It's hard to live under a cloud of false accusations for so many years. The fact that the jury said we never even saw the script - justice has been done." »

His last film was the underrated 2008 film Traitor and he helmed a couple of episodes of the much-loved Showtime series Homeland. Now, writer/director Jeffrey Nachmanoff is set to take on a film adaptation of the Vince Flynn novel American Assassin for CBS Films.

American Assassin Gets Director Jeffrey Nachmanoff

CBS Films has brought on Jeffrey Nachmanoff (Traitor) to direct the action-thriller American Assassin.

We first reported on this project back in June, when CBS Films set the project up for Edward Zwick to direct from a script he co-wrote with Marshall Herskovitz. It is said Edward Zwick left the project to direct The Great Wall with Henry Cavill. It isn't known if Jeffrey Nachmanoff will direct from Edward Zwick and Marshall Herskovitz's script, or if new writers will be brought in.

American Assassin is adapted from the Vince Flynn novel of the same name. American Assassin is the 11th novel in his series about CIA agent Mitch Rapp, although this book is a prequel, showing how a younger Rapp overcame tragedy and worked his way into the CIA.

It isn't known when production may begin on American Assassin.

American Assassin comes to theaters in 2013. The film is directed by Jeffrey Nachmanoff. »

Jeffrey Nachmanoff ("Traitor") is set to replace Ed Zwick at the helm of "American Assassin" for CBS Films says Deadline.

An adaptation of the Vince Flynn novel, the aim is to launch a potential spy thriller franchise following the central character - CIA agent Mitch Rapp. Zwick and Marshall Herskovitz wrote the most recent draft of the script.

'Assassin' is the eleventh book in the series, but is a prequel which makes it perfect for a first film to explore how personal tragedy transformers a college scholar and athlete into a ruthless hunter of terrorists for the CIA. Lorenzo di Bonaventura and Nick Wechsler are producing.

CBS Films acquired rights to the series back in 2008 when it attempted to adapt "Consent to Kill" with Antoine Fuqua helming and the likes of Gerard Butler and Colin Farrell up for the role of Rapp. »

The book is actually the 11th in Flynn’s series that centers on CIA Agent Mitch Rapp. Assassin serves as a prequel to the series and tells the story of how, as a college scholar and athlete, tragedy forged Rapp’s path to become a ruthless hunter of terrorists for the CIA. Edward Zwick was initially tapped to direct the film, but he dropped out when the schedule conflicted with his next directorial effort, The Great Wall. Nachmanoff previously directed the 2008 thriller Traitor starring Don Chedele, and recently helmed two episodes of Showtime’s fantastic series Homeland. 'Breaking Bad,' 'Homeland,' 'The Descendants' take home Writers Guild Awards

"Homeland," "Breaking Bad" and "Modern Family" each won two honors Sunday (Feb. 19) at the Writers Guild of America Awards.

On the film side, the scripts for "The Descendants" and "Midnight in Paris" earned awards from the guild. The WGA gave Laurel Awards -- for writers who have "advanced the literature" of movies or television -- to "Forrest Gump" and "The Insider" scribe Eric Roth for film and to "thirtysomething" and "Once and Again" creators Ed Zwick and Marshall Herskovitz for television.

Man of Steel Casting News: Russell Crowe Sought for Harker; Henry Cavill Heads to The Great Wall

Interest in having Russell Crowe appear in nearly every production currently being readied in Hollywood continues, this time with Harker, a re-imagining of Bram Stoker's novel Dracula.

According to Vulture, Warner Bros. is in talks with Crowe to play the title character of Jonathan Harker, who is now a Scotland Yard detective investigating a string of murders that should lead him to the nefarious Count. The project has been lingering around Warners for a while now, but with the studio's adaptation of Akira recently shut down over budget concerns, Harker has regained momentum. The report claims that the studio wants director Jaume Collet-Serra (Unknown, ABC's The River) to helm Harker first, and then address Akira's budgetary issues.
