Jay Mohr is alleging that his estranged wife Nikki Cox battles both drug and mental health issues and is requesting sole physical custody of their son, according to new court documents obtained by People.
In the documents filed March 10, Mohr, 46, is requesting sole physical custody of their five-year-old son, Meredith Daniel Cox Mohr, and joint legal custody, with Cox receiving “reasonable visitation with Meredith, which shall be professionally monitored.”
The new filing comes three months after Mohr filed for divorce from Cox for the second time on Dec. 13 and initially requested joint legal and physical custody of their son.

Criss Angel is opening up about that scary stunt.
The 49-year-old magician spoke out on Monday after recovering from a scary incident at Friday night's Mindfreak Live! performance.
During the show, Angel lost consciousness while attempting an upside down straitjacket escape, after which he was promptly rushed to the hospital.

"This is real," Angel told ABC News of the incident. "I blur the line between reality and illusion but this demonstration and the risks that are at stake are no joke."
Fascinatingly, the magician returned to the stage one night after the accident to perform the same stunt that left him unconscious at the previous show.

"What doesn't kill you makes you stronger and for me it's always about pushing my envelope," Angel said.
The 36-year-old comedian recently sat down with Et's Kevin Frazier while filming Wild 'N Out: Live in Times Square, where he opened up about not wanting to be "defined" by his job, whether it's as the host of a hugely popular reality TV show, a musician, a producer or a stand-up comic.
"The entertainment industry itself [can] compartmentalize you," Cannon shared. "[People] get caught in a sense of like, 'You should be happy to be here,' or, 'It is the dream job. Things like this don't come along to everyone.' But things like that don't define me."
